Can the state get make you let them call your doctor and get medical information?
K story time, my buddy has been going through a nightmare because of a dui charge 8 years ago… yes 8 years, he’s been to jail, done house arrest and been on probation, and this just in the last year… he hasn’t failed any drug tests or alcohol tests…question is that the state is now telling him he needs to sign a paper giving them the right to contact his doctor. He already gave them a paper saying what he sees him for and what he’s prescribed, also he signed the paper letting them contact his psychologist just not the main doctor. They are now wanting to put him in jail for a probation violation. CAN THEY DO THAT? Oh the state is Utah.
Yes they can do that. Apparently a condition of his probation was that he allow the release of his medical records. If he refuses then he is in violation of his probation.
They can’t force him to, but they can make it a condition of probation. He has every right to refuse, and they have every right to revoke probation and put him in jail.

When you’re on probation you don’t have the same rights everyone else does. He needs to follow everything they say or he can go back to jail.

He can sit in jail for not doing what he is told, but the judge will type an order to that dr. ordering them to give them the records and your buddy will still not get out because he refused to help. bad move their going to get it either way.
