May I contact an out-of-state attorney for wrongful death if I have an attorney in my home state?

Husband was Arkansas resident, as am I. Was killed in Florida at landfill during Hurricane clean-up on 11/23/05. Do I have to go through my attorney here, who has been unwilling to pursure my request, to contact an Florida attorney to determine if there could be merit to this accident. It seems, unlike in the medical profession, if you are unsatisfied with a diagnosis, you are allowed to consult for a second opion. Why is this not allowed in the legal profession. This situation has been dragged out for over a year. I have spent my own monies researching, gathering info, providing to this attorney and so far, things remain at a standstill.

Absolutely! There’s nothing that’s stopping you from contacting another attorney, either in your home state or in Florida. Your present attorney may have a particular person he wants to work with, but that has no effect on you.

Butbefore you do this, practice common courtesy and inform your current counsel that you feel the case isn’t moving fast enough, that you are displeased, and you will be seeking your own attorney in Florida to handle the matter. Perhaps he will wake up, or at least give yuo an opinion why he hasn’t moved faster.
(P.S. sometimes statutes of limitations on tort actions are very short, so I’d get cracking!)

  3. You can always get a second opinion, but you should NEVER consult or retain two lawyers for the same legal issue (potential conflicts of interest). In your case, the laws of the state of Florida govern whether you can file a wrongful death suit because the incident giving rise to the lawsuit occurred in Florida, so you would need to contact a Florida attorney to get the proper guidance. As for this attorney that has been dragging his/her feet, you should demand your money back and threaten to report him/her to the State Bar Association and the Better Business Bureau if he/she doesn’t refund the legal fees you have paid. If he/she doesn’t do as you ask, call the State Bar Association and the Better Business Bureau.
