Can CPS take my child away from me becasue I take prescription pain killers(legally)?
I have a prescription for some heavy duty pain killers. I had a big blowout with some people that I used to associate with and they called CPS on me, making false accusations that I "shoot up" my pain killers. When the CPS worker 1st came out, he could plainly see that I have no marks on my arms/hands and that I have a prescription for the medication I am taking. He counted my pills, and the count was what it should have been(indication that I am not abusing my RX). The CPS worker stated to me that he wants me to have a drug dependency evaluation and he also wants me to sign a release form allowing him to contact my doctor and he also wants me to ask my doctor to switch me to a non narcotic pain killer….which won’t work becasue I have a broken back and a torn rotator cuff and I have a legit reason to be taking the medication I am on. I do not want to sign the medical release form, I do not want to change my medication and I do not want to loose my son. Obviously, if it came down to it, I would give up the pain killers and live in pain every day if I had to choose between that and my son. BUT they have drug tested me and I passed, they came to my home and found no evidence of abuse or neglect, they have nothing to hold against me(in my opinion) but they want me to jump through hoops for some unknown reason. Do I have to submitt to a drug dependency evaluation and do I have to sign the medical release form? All they want to do is meddle with my medication. What can I do to help myself and my son?

Do not sign the forms, PERIOD. NO government agency has the right to force you take such test or release your records without a court order.
They have made their preliminary investigation and have no grounds for further action. If they persist get a lawyer. You may have grounds for a harassment suit

You can litigate against this. Ultimately, if you refuse, CPS would likely have to initiate a legal proceeding – that is go before the judge and get an order allowing them to either force you to do what they say or lose your kids. At this point, you’d be able to argue back.
The ultimate issue is – what is best for the children. (Assuming the equities are roughly equal, materially changing your parental rights would still be a problem.) They would have to prove the facts (not beyond a reasonable doubt , however) that establish their right to do what they are asking for.

The CPS workers are NOT medical professionals , and therefore have NO right to insist on a change of medication !
You do NOT have to submit to a drug dependency evaluation , and you DON`T have to sign ANYTHING they want you to ! in fact , you should NEVER sign anything these aasssholes tell you to, because then they`ve got you in chains forever !!
Get a lawyer NOW ……… and use a Public Defender only as a last resort !

If you gave up your pain killers and went around in pain all day, you probably wouldn’t function as well to take care of your son, plus you’d lose your temper a lot more because of all the pain. Then they could get you in trouble for emotional abuse! CPS are not medical people. Who are they to do this to you? Get an attorney if you possibly can.
