Will they help me? Do I have a right to help?

I was at a local park yesterday. It’s also a historic site, it used to be a fort. There were stairs. As I was going down the steps on the last step I stepped in a hole. It was covered by leaves so it was not visible. My husband went and took pics and took me to the hospital. I have a severely sprained ankle. I’m wondering if they are responsible.

I also wanted to add that the leaves have been gone from the trees here for QUITE some time so does that mean they were negligent because they did not upkeep the park? Also for the whole being there especially at the bottom of stairs where you have to step?

I do not have insurance so I am just wanting them to cover the medical bills. Should I just contact them and tell them what happened? I really want to call tomorrow when the offices open because I dont want this happening to someone else! (We did rake the leaves aside so that HOPEFULLY it wont happen to someone else!)

Also, There are no park personnel. There is no office at the park. There is no phone number listed anywhere at the park. Today I was able to find out it is owned by the city, they open tomorrow.

I spent the day in the emergency room. A sprained ankle is NOT a small thing. Emergency rooms cost A LOT and xrays, crutches, plus the doctor thinks more might be wrong so I have to see a specialist.
Plus, I am not able to even use crutches yet. I am ordered to stay in bed for AT least 3 days or until I think I can move it properly THEN try to put some weight on it.
I dont even WANT to sue. I hate when people do that. Accidents happen. I just dont want to be responsible for my medical bills because they failed to upkeep the place.

YES, you can absolutely sue them for negligence, particularly since it was not an avoidable accident. It no different than if it was wooden steps and one of them gave way due to years of neglect and wood rot.

Through taxes, we pay a LOT for maintenance of these parks, but the personnel spend more time policing parking spots and fees than they do actually maintaining the parks. Even though anything you sue them for will end up coming out of taxpayers pockets, it’s the only way you can draw attention to the fact that government people are being paid for work that they are not doing.

Definitely contact a lawyer tomorrow. Don’t even go to the city. Go straight to a laywer.

Okay, maybe you shouldn’t shop for a Cadillac (LOL, I just love "Sanford and Son" and that is one of the funnier episodes). But definitely get them to cover 100% of your medical expenses and time lost from work. Like I said, at least it will get someone reprimanded, and if we’re all lucky, maybe even get them fired and replaced with someone who actually cares about the park’s maintenance.

  4. talk to a lawyer. If you are going to get money from them, just get it to cover the medical bill.

  5. Yes, because at this point all you can do is notify them of what happened, present your expectation and if they don’t co-operate you can always tell them that you want to seek the opinion of the law. And you have that right.

  7. OMG that happened to me before someone did it o purpose when it happened to me and your story sounds like it was on purpose tell them what happened and remeber to ask them ?’s like if there is no leaves out for awhile why were they there… or why didnt they fix the whole thats were people walk

  9. The liability rests with what ever government entity controls the historic site. is its is a town historic site then the town is responsible. If it is a state site then the state is responsible. My best suggestion for you is to find an attorney because whatever government agency is responsible they are not just going to pay for your bill with out some kind of litigation.
